Terms of service

Last updated: September 18, 2026

Overview

Welcome to WIT & FORTUNE. In these Terms of Service, “we,” “us,” and “our” refer to the business operating WIT & FORTUNE, identified in our Legal Notice. We operate witandfortune.com and provide the products, content, and related services available through it (the “Services”). Our store is hosted by Shopify.

These Terms explain your rights and responsibilities when using the Services or buying from us. They should be read with our Privacy Policy, Shipping Policy, and Return and Refund Policy. By using the Services, you agree to these Terms to the extent permitted by applicable law. If you do not agree, please do not use the Services.

Nothing in these Terms excludes or restricts rights or remedies that applicable law does not allow us to exclude or restrict. This applies to every section, including the provisions concerning Shopify, warranties, liability, and disputes.

Section 1 — Access and account

You must have the legal capacity to enter into a purchase contract. If you are under the age of majority where you live, a parent or legal guardian must authorize and take responsibility for purchases where permitted by law.

Please provide accurate, current information when placing an order, creating an account, or contacting us. You are responsible for keeping your account credentials secure and notifying us if you suspect unauthorized access. You may not sell or transfer your account without our written consent.

Section 2 — Our products

We aim to describe and display products accurately. Colors and finishes may appear differently depending on your screen and lighting. These ordinary display differences do not remove your rights if an item is materially different from its description.

Please review the product description, dimensions, materials, included items, care instructions, and any safety or age guidance before ordering. Follow instructions supplied with the product.

We may update descriptions, discontinue products, or limit quantities for future purchases. Changes do not retroactively alter an accepted order or reduce your statutory rights.

Section 3 — Orders

Placing an order is an offer to purchase the items selected. An automated acknowledgment confirms receipt of your order. Acceptance occurs when we confirm acceptance or dispatch the order, unless applicable law provides otherwise.

We may decline or cancel an order for a legitimate reason, such as unavailable stock, an unresolved payment issue, suspected fraud, a material pricing error, or an unavailable delivery destination. We will contact you where appropriate and refund any payment for an order we cannot fulfill, as required by law.

Please check your order and delivery information before submitting it. If you need a change or cancellation, contact hello@witandfortune.com as soon as possible, preferably within 48 hours. Fulfillment may prevent us from changing an order or stopping a parcel. This does not limit statutory cancellation rights or returns available under our Return and Refund Policy.

Our store is intended for personal and household purchases. Please contact us before placing a commercial resale or bulk order.

Section 4 — Prices and billing

Prices and promotions may change for future orders. The price and currency shown when you submit your order apply, subject to any lawful correction process described in Section 12.

For orders we accept, product prices include applicable taxes and import duties, and standard shipping is free to destinations available at checkout. The amount payable is displayed before you place your order. We will not add an optional charge without your agreement. Your bank or payment provider may apply its own currency conversion or transaction charges.

Please keep your billing and contact information accurate. By providing payment details, you confirm that you are authorized to use the payment method. An order may be delayed or declined if payment cannot be authorized or verified.

Any separate promotion terms apply to the relevant offer, but do not remove mandatory consumer rights.

Section 5 — Shipping and delivery

Our estimated delivery time is 8–12 calendar days from the date of the order, including processing and transit. Destinations, tracking, delivery assistance, and our missing-delivery replacement service are explained in our Shipping Policy.

Delivery estimates can be affected by circumstances such as carrier disruptions or customs processing. We will provide assistance with delayed, lost, or damaged deliveries. Risk does not automatically transfer to a consumer simply because we hand a parcel to our carrier; the applicable consumer-law rules govern responsibility for delivery.

Section 6 — Intellectual property

Content on the Services, including text, graphics, photographs, designs, and branding, belongs to us or its respective owners and is protected by applicable intellectual property law. Third-party names and marks remain the property of their owners.

You may view the Services and make copies reasonably necessary for personal shopping, keeping order records, and exercising your legal rights. Except as permitted by law or with the rights holder's permission, you may not reproduce, sell, distribute, or commercially exploit protected content.

These Terms do not grant a license to use WIT & FORTUNE branding or Shopify branding beyond the use necessary to access the Services.

Section 7 — Optional tools

We may make third-party tools available through the Services. Separate terms may apply to those tools, and we do not control their independent operation. Review the relevant provider's terms before using an optional tool.

To the extent permitted by law, we do not provide additional warranties for independent third-party tools. This does not remove our obligations for a purchase made with us or responsibilities that cannot lawfully be excluded.

Section 8 — Third-party links

The Services may contain links to websites operated by third parties. A link does not by itself mean that we endorse all of that website's content or services. Review the third party's policies before sharing information or entering into a transaction there.

Questions about an independent third-party service should be directed to its provider. Questions about an order placed with WIT & FORTUNE should be directed to us.

Section 9 — Relationship with Shopify

WIT & FORTUNE is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with WIT & FORTUNE. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and WIT & FORTUNE, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with WIT & FORTUNE.

Section 10 — Privacy policy

Our Privacy Policy explains how personal information is collected, used, shared, and handled in connection with the Services. Certain processing is also described in Shopify's Consumer Privacy Policy.

Shopify hosts our store and processes information when you visit or buy from us. This includes providing services informed by your interactions with our store, other merchants, and Shopify. Information may be shared with Shopify and other service providers in countries other than where you live to provide these services.

Please review our Privacy Policy for the applicable details and choices. Information about rights relating to Shopify's processing is also available through Shopify's privacy portal. Agreement to these Terms does not replace consent where separate privacy or cookie consent is legally required.

Section 11 — Feedback and reviews

If you submit a review, photograph, or other material for public display, you confirm that you have the rights needed to share it and that it accurately reflects your experience. Please disclose any incentive or other material connection relevant to a review.

You give us a non-exclusive, worldwide, royalty-free license to display, reproduce, and reasonably format that submitted material in connection with our store and its marketing, subject to applicable law and your privacy rights. This permission does not make private customer-support messages, order information, or return photographs available for public advertising without an appropriate separate basis.

We may moderate unlawful, abusive, misleading, irrelevant, or rights-infringing content. We do not require reviews to be positive. You must not impersonate another person or submit a review of an experience you did not have.

Section 12 — Errors, inaccuracies, and omissions

If we discover an error in product information, availability, pricing, or an order, we will take reasonable steps to correct it. If an error materially affects an order you have placed, we will contact you with the available options, such as proceeding on corrected terms or canceling for a refund.

We will not charge a higher price or substitute a materially different product without your agreement. Any correction or cancellation remains subject to applicable law.

Section 13 — Prohibited uses

You must not use the Services to commit fraud, break the law, infringe another person's rights, harass others, submit deceptive information, distribute malicious software, or interfere with the security or operation of the store.

You must not misuse another person's account or payment details, collect personal information without an appropriate legal basis, send unsolicited spam through the Services, bypass access controls, or use automated activity to disrupt or overload the Services.

We may take proportionate action against misuse, including restricting access or declining a fraudulent transaction, subject to applicable law. Such action does not remove any refund or other obligation we owe for an existing order.

Section 14 — Agents

If you use an automated agent to access or interact with the Services on your behalf, you remain responsible for its authorized actions to the extent provided by law. The agent must accurately identify its automated nature where identification is required and must follow applicable access restrictions and technical controls.

Agents must not falsely claim to be human, impersonate someone else, bypass CAPTCHA or other security controls, or evade a restriction on access. No agent may place an order or share personal information without the relevant person's authority. We may restrict automated activity that compromises security, performance, or lawful operation of the Services.

Section 15 — Termination

You may stop using the Services at any time. We may suspend or terminate access for a material breach of these Terms, unlawful activity, or a legitimate security reason, with notice where required by law.

Termination does not cancel our obligations for accepted orders, refunds, or statutory rights, or amounts lawfully owed before termination. Provisions that by their nature need to continue, including intellectual property, privacy obligations, and applicable liability provisions, remain effective to the extent permitted by law.

Section 16 — Disclaimer of warranties

We take reasonable care in providing the Services, but do not promise that the website will always operate without interruption or technical error. General articles and other editorial content are provided for information and do not replace instructions supplied with a product.

To the extent permitted by law, the website and optional online tools are provided without additional guarantees beyond those expressly stated. This does not disclaim statutory warranties or consumer guarantees for products, the requirement that goods match their description, or other rights that cannot be excluded.

Section 17 — Limitation of liability

Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such liability cannot be excluded, or any other liability that applicable law does not allow to be limited. Mandatory consumer remedies remain available.

To the extent permitted by law, we and our service providers are not liable for losses that were not reasonably foreseeable when the relevant contract was made, or business losses arising from purchases intended for personal or household use, such as lost business profits or opportunities.

Any limitation in these Terms applies only to the extent permitted in your circumstances and does not exclude liability that the law requires us to accept.

Section 18 — Indemnification

To the extent permitted by law, you are responsible for reasonable losses arising from a third-party claim caused by your unlawful use of the Services or your intentional or negligent infringement of another person's rights. This does not make you responsible for losses caused by our own wrongdoing or for simply exercising consumer rights.

If such a claim arises, we will notify you within a reasonable time and give you a reasonable opportunity to participate in its defense. We will not agree to a settlement imposing an obligation on you without your consent where that consent is required by law.

Section 19 — Severability

If a provision is held unlawful or unenforceable, it will not be applied to the extent it is unlawful or unenforceable. The remaining provisions continue to apply where the contract can lawfully continue without it.

Section 20 — Waiver; entire agreement

Our failure to enforce a provision on one occasion does not waive the right to enforce it later. These Terms, the linked policies, and the terms of an accepted order describe our agreement concerning the Services and that purchase.

Nothing in this section excludes liability for misleading statements or removes rights arising from information or promises on which applicable law allows you to rely. Mandatory rules about interpreting consumer contracts continue to apply.

Section 21 — Assignment

You may not transfer your contractual rights or obligations without our consent, except where the law permits. We may transfer our rights and obligations in connection with a lawful business transfer, provided this does not reduce your mandatory rights or materially worsen your position under an existing order. We will notify you where the law requires it.

Section 22 — Governing law

The law applicable to these Terms and any purchase will be determined under the applicable conflict-of-laws rules. Nothing in these Terms deprives you of mandatory consumer protections available under the law that applies to you, including protections of your country of residence where applicable.

These Terms do not require a consumer to bring a claim exclusively in a foreign court where applicable law gives that consumer the right to use their local courts.

Section 23 — Headings

Headings are included for convenience and do not change the meaning of these Terms.

Section 24 — Changes to these Terms of Service

We may update these Terms to reflect changes to the Services, our operations, or legal requirements. The current version and its update date will be available on this page. We will give additional notice or obtain consent where required by law.

Changes apply prospectively and do not retroactively reduce your rights under an existing order. Continued use of the Services after an update is subject to the updated Terms only to the extent permitted by law.
